March 18, 2008 04:49 PM – The unprecedented motion to request bail for Rambo, the alleged pit bull, won’t be heard until May.
“I feel terrible,” the dog’s owner, Gabriela Nowakowska, 20, told The News this afternoon after court officials put the case over.
Nowakowska’s lawyer, Anik Morrow, met with the Crown Attorney and a Justice of the Peace in a pre-trial meeting for more than an hour behind closed doors at the provincial courthouse, at 950 Burnhamthorpe Rd. W.
“I really wanted him to come out today,” a disappointed Nowakowska said after being informed that three days will be set aside in May for a hearing. That’s when Morrow will argue that Rambo, who’s about 10 months old, should be released from the Mississauga Animal Control Centre into his owner’s care.
The dog was seized by Animal Control on Christmas Day after it escaped from Nowakowska’s back yard. The Mississauga resident has been charged with owning a prohibited animal under the Dog Owners’ Liability Act, approved in 2005.
“This is a new law, so the motion has to be argued for visitation rights,” Morrow said following the 100-minute hearing. “There is no precedent.”
Morrow, who will be filing an official motion to release the dog in the next few weeks, said she will argue “by analogy” that there is provision under the Act to release Rambo.
“The person charged is Nowakowska, but the item seized is the dog,” she said. “We will be asking for a visitation order on the item seized. The item is depreciating and losing its intrinsic value,” because the bond between Rambo and its young owner is being disrupted.
The Crown will oppose the release, Morrow said. She hopes a specific Crown Attorney can be assigned to the case soon so discussions can begin on narrowing the issues to be heard.
The case could not be heard any earlier because “it is novel for everyone” and will require several days of testimony. May is the earliest such a lengthy review could be held. Morrow has already lined up an expert witness to testify.
Her client will agree with all reasonable conditions if bail is granted, including reporting regularly with Rambo to Animal Control, keeping him indoors, muzzling him in public when he does go outside and posting bond.
Morrow said she is optimistic about winning the case because she believes a clause in the law that prohibits dogs believed to be pit bulls or dogs with “substantially similar” characteristics is “vague and unconstitutional.”
Morrow said, “it’s a difficult clause to enforce because it begs an arbitrary application.”
Two parts of the legislation have already been struck down by a lower court. The entire Act is under appeal by famed Toronto lawyer Clayton Ruby on behalf of several animal welfare groups.
The matter should be heard this fall.
