January 2010, an innocent family in Brampton had law enforcement and animal control officers, without a warrant, force their way into their home and removed their family pet that has never had a complaint or incident and does not fall under the Breed Specific Legislation.
6 police officers and 3 Animal Control Officers were called to remove a docile dog.
Another dog owner, a 75 year old senior citizen was threaten by an Animal Control officer that if she did not hand over her dog police would be called.
Both dogs, Brittany and Rambo are from the same mother and father. The father is 50% American Bulldog and 50% Boxer The Mother is 100% Boxer.
The family has provided Brampton Animal Services with vet papers stating the parentage of Brittany and Rambo as well Microchip Registration form stating the father is American Bulldog mix. Brampton Animal Services maintain the father of the two dogs in custody is a “Pitbull” mix and has yet to produce any paperwork proving this. Brittany and Rambo were scheduled for euthinization on February 5th, 2010 but the City has granted an extension as this matter is going to court.

Dog owners still pitted against animal control

For Brittany and Rambo — a couple of dogs labelled as pit bulls — life is, well, the pits.
So say the owners of the dogs, which remain in the custody of Brampton Animal Services, having been seized Jan. 13 on the assumption they’re pit bulls.
Rui Branco, whose brother, Joseph, owns Brittany, says the family vet was denied access by the city to visit the caged animals Tuesday, a day after the city gave permission.
He said it’s a stressful situation for the families because they don’t know what conditions the dogs are living in.
“Monday afternoon, we negotiated with the city that he could come and then at 12:38 p.m. on Tuesday afternoon, they send my lawyer a letter telling us the vet can’t come and the city will provide us with a report on the welfare of the animals,” Branco, 42, said. “They didn’t give us a reason.”
Animal control officers took Brittany and Rambo from two separate owners — Joseph Branco and Maria Gaspar — without a warrant, the owners claim.
The families say veterinary records show that the dogs are 75% boxer and 25% American bulldog.
Brampton Animal Services said it had a right to remove the dogs, because Tyson, the father of the two-year-old siblings, was registered as a restricted pit bull in 2008 and was not allowed to breed.
Pit bulls were banned from the province as of Nov. 29, 2005.
A fax document dated Tuesday and signed by deputy city solicitor Kelly Yerxa said: “Unfortunately, we cannot agree to the examination at this time, however … we are having the city’s vet examine the dogs and that vet’s report will be provided to you. The dogs are being well cared for by Animal Control staff.”
A Brampton Animal Services spokesman could not be reached for comment Wednesday.
Branco said Wednesday his lawyer has filed a complaint with the Ontario Society for the Prevention of Cruelty to Animals. His lawyer plans to file an application to the Ontario Superior Court by the end of the week.
“The city is being ridiculous and I don’t know what they’re trying to accomplish by keeping us from seeing the animals,” Branco said. “Those animals are locked up a minimum of 23.5 hours a day. That’s not humane. That poor old lady (Gaspar) calls me three times a day, everyday, devastated, asking me if I’ve heard anything.”
