January 2010, an innocent family in Brampton had law enforcement and animal control officers, without a warrant, force their way into their home and removed their family pet that has never had a complaint or incident and does not fall under the Breed Specific Legislation.
6 police officers and 3 Animal Control Officers were called to remove a docile dog.
Another dog owner, a 75 year old senior citizen was threaten by an Animal Control officer that if she did not hand over her dog police would be called.
Both dogs, Brittany and Rambo are from the same mother and father. The father is 50% American Bulldog and 50% Boxer The Mother is 100% Boxer.
The family has provided Brampton Animal Services with vet papers stating the parentage of Brittany and Rambo as well Microchip Registration form stating the father is American Bulldog mix. Brampton Animal Services maintain the father of the two dogs in custody is a “Pitbull” mix and has yet to produce any paperwork proving this. Brittany and Rambo were scheduled for euthinization on February 5th, 2010 but the City has granted an extension as this matter is going to court.

Dog owners still pitted against animal control

For Brittany and Rambo — a couple of dogs labelled as pit bulls — life is, well, the pits.

So say the owners of the dogs, which remain in the custody of Brampton Animal Services, having been seized Jan. 13 on the assumption they’re pit bulls.

Rui Branco, whose brother, Joseph, owns Brittany, says the family vet was denied access by the city to visit the caged animals Tuesday, a day after the city gave permission.

He said it’s a stressful situation for the families because they don’t know what conditions the dogs are living in.

“Monday afternoon, we negotiated with the city that he could come and then at 12:38 p.m. on Tuesday afternoon, they send my lawyer a letter telling us the vet can’t come and the city will provide us with a report on the welfare of the animals,” Branco, 42, said. “They didn’t give us a reason.”

Animal control officers took Brittany and Rambo from two separate owners — Joseph Branco and Maria Gaspar — without a warrant, the owners claim.

The families say veterinary records show that the dogs are 75% boxer and 25% American bulldog.

Brampton Animal Services said it had a right to remove the dogs, because Tyson, the father of the two-year-old siblings, was registered as a restricted pit bull in 2008 and was not allowed to breed.

Pit bulls were banned from the province as of Nov. 29, 2005.

A fax document dated Tuesday and signed by deputy city solicitor Kelly Yerxa said: “Unfortunately, we cannot agree to the examination at this time, however … we are having the city’s vet examine the dogs and that vet’s report will be provided to you. The dogs are being well cared for by Animal Control staff.”

A Brampton Animal Services spokesman could not be reached for comment Wednesday.

Branco said Wednesday his lawyer has filed a complaint with the Ontario Society for the Prevention of Cruelty to Animals. His lawyer plans to file an application to the Ontario Superior Court by the end of the week.

“The city is being ridiculous and I don’t know what they’re trying to accomplish by keeping us from seeing the animals,” Branco said. “Those animals are locked up a minimum of 23.5 hours a day. That’s not humane. That poor old lady (Gaspar) calls me three times a day, everyday, devastated, asking me if I’ve heard anything.”

This is considered to be a peaceful protest to show the City of Brampton and Animal Control Services that the pet owners of Brampton and Ontario will not stand idly by while our civil rights are abused and our pets put in harms way by the system established to protect them. Pet owner or not, all are welcome as this should concern all Ontario residence.

Parking: You can park anywhere south on Chrysler drive as most business arre not open on Saturday: DO NOT PARK ON BRAMPTON ANIMAL SERVICES PROPERTY OR ON ANY OF CHRYLER”S PROPERTY.

Gathering Spot: On the south eat side on Chrysler Drive there is a Waste Managment center to the South of Brampton Animal Services. We will all meet there.

DO NOT GO ON THE BRAMPTON ANIMAL SERVICES PROPERTY.

WE ARE NOT TO IMPEED BRAMPTON ANIMAL SERVICES OPERATIONS. WE ARE NOT TO IMPEED TRAFFIC TO AND FROM ANY BUSINESS IN THE AREA.

If we are asked to move by Peel Regional Police we will comply in a peaceful manner.

Here are the facts:

In January 2010 Brampton control officers and Brampton police officers remove Britany and Rambo, by force with no warrant, from their owners residence.

Never a complaint was filed by anyone in the community. The dogs have never been involved in biting incident or aggression toward a Brampton citizen.

According to offical documents produced by Brittany and Rambos owners, the dogs are 75% Boxer 25% American Bulldog

Brampton Animal Services believe they where in full rights to remove the dogs from the owners as they say they have the father of the two dogs license registration indicating he is registered as a pitbull. The family has said no paperwork was submitted and only the fee and tags and receipt were exchanged when the Control Officer in 2008 first went to the Brano’s family home. The Same Control officer that was involved in the seizure of the dogs in January 2010.

The family has submitted paperwork stating Tyson, the father, is Boxer/American Bulldog mix from their family veterinarian(50 years and the only vet to examine Tyson) and microchip registration form.

Brampton Animal Services has produced a document from “their” vet…who does not practice in Brampton but Maple Ontario, Stating Brit and Rambo are pitbulls but with no mention of how this was determined. The family is requesting further explanation of how this vet came to this conclusion.

Brampton Animal Services have extended the schedule for euthenization until an undetermined date as this matter is now going to court. If the court finds in the City’s favor then the families will have no choice but to move the dogs out of province.

May the protest be out of love for the dogs and support of the familys involved, not out of anger for the system.

Administrators of this group are not the protest organizers. The protest is being organized by members of this group. This FB Group is to be considered a communication tool for all those who are concerned about this issue.

I have been served papers to attend court for Sasha beucase the City said she had ” SIMILIAR FEATURES” to that of a pit bull. It is up to me to prove she is not other wise she will be put down. I have tried many different things and even have papers from the vet saying that she is not a pitbull and they are not accepting it . they want a letter from my vet saying that he came up with that type of breed becuase apparently we are the ones that tell our vet what type of breed it is.

I was told by my vet at Luzon hospital that he will not get involved because the veterinarian association monthly news letter tells them not to get involved. I was also told this by other vets I have called for help.

If I do not get help for her fast she will be put to sleep without a second thouht.

I have court on Monday Feb 23rd at 9 am courtroom 301 at the westcourt place ( same place for traffic violations) and they are setting the date for trial since I can not get the documents I need from the vet becuase the vets will not get involved.

Anyone is welcome to attend court or offer advice or sugestions I can not do this alone I need help

Today I was able to have the court remanded until March 16th so I have time to get more information aswell as seek legal council. New court date is March 16th at 9 am westcourt place 301

Trial Date is set for June 10th I am going to try to get an extension on it. I have been in contact with a few wonderful people who are willing and able to help. Right now I have more hope then I ever have. Thank you soo much. Thank you to my best friend Jo-ann for finding this site and helping me stay strong you are one of a kind girl I love you.

The Mississauga dog, who became famous after being locked up on death row for 10 months at the City’s animal control centre because of Ontario legislation banning pit bulls, is adjusting well to his new life of freedom, according to the rescue organization that moved him to the east coast.
“Rambo is going to spend his first Christmas ever in a home this year, a home where he’s allowed to live his life and not be hunted nor hidden,” Lee-Anne Tibbo, of Ador-a-Bull Dog Rescue, said in an e-mail to The News.
It was early on Christmas Day last year that the mixed-breed puppy was picked up by an animal control officer in east Mississauga. Rambo had escaped from the backyard of the house where his owner, Gabriela Nowakowska, was a tenant.
Nowakowska was charged with owning an illegal dog, prompting a lengthy legal battle over the controversial law that banned Ontarians from acquiring new pit bulls after 2005.
A plea bargain was reached in October; Nowakowska pleaded guilty, received a suspended sentence and agreed that Rambo — whose life she said was being wasted in captivity in the City’s animal control shelter — would be sent to another province.
“He’s been adopted by a wonderful family and has a canine sibling,” Tibbo said. “He’s settling in well and having a great time there, getting to be a dog. He’s adored very much and I know that he’s going to have a fantastic Christmas filled with many dog cookies and toys.”
Tibbo said she found Rambo “a great dog” in the time she trained him before he was adopted out.
“During his months with me, he did have to learn a lot,” she said. “He had to learn a lot about life’s experiences and how to behave properly, but never once did he show any resistance or aggressive behavior. He continued to be a fantastic house guest and he fit in very well.”

Bowser another Rambo case?

By: Julia Le February 3, 2009 02:41 PM - In what is shaping up as a sequel to the Rambo tale, a Mississauga man’s puppy might be euthanized or shipped out of province if his owner can’t prove he’s not a pitbull.
Danny Truong was charged with owning a prohibited animal just before Christmas last year after he took his 10-month-old puppy Bowser to be neutered at a veterinary clinic on Nov. 25.
The 21-year-old said he was shocked three weeks later when City animal services officers came knocking at his home near Square One, charging him under the Dog Owners’ Liability Act. Truong said the officers told him that the veterinary clinic had made a complaint.
Truong, who was charged on Dec. 15, made his first appearance in court last Friday. His case was adjourned to Feb. 27, when a date for trial will be set.
Bowser’s case is a repeat of Rambo, an alleged pit bull who was shipped out of Ontario to a Nova Scotia home last year after a highly-publicized legal battle.
Rambo’s owner, Gabriela Nowakowska, was charged on Christmas Day 2007 when the City’s animal control department caught the puppy running loose. Nowakowska pleaded guilty to possessing an illegal dog and was given a suspended sentence on the condition that Rambo would be shipped from the City pound to Nova Scotia.
Truong, visibly upset at the prospect of losing Bowser, said he’s being discriminated against based on his dog’s appearance.
He said he received Bowser as a gift from his niece and was told by the lady selling the pup that he was a Rottweiler-Boxer mix.
Selma Mulvey, an advocate for dog owners’ rights, says dog owners have no way of knowing whether or not they are breaking the law because the legislation is vague.
Mulvey says a pitbull is a slang term and dog owners have no way of knowing how they are violating the law.
“Truong is a responsible owner. He’s trained his dog, he’s socialized his dog, and he took it to get neutered … and suddenly he’s accused of a serious crime,” she said.
Truong says he’s never had any problems when taking the dog to the park, pet stores or his regular veterinarian.
“Bowser is very friendly,” he said. “Anyone that comes across my dog loves him. He doesn’t bite and he’s pretty outgoing and jumpy.”
